Consultant – Legal Analyst, Electoral Expert Mission, Venezuela

Contingent on availability of funding, the electoral calendar, and developments related to COVID-19, The Carter Center is preparing to deploy an Electoral Expert Mission (EEM) to Venezuela for the regional elections to be held on November 21, 2021.

The Center is seeking a highly qualified individual to serve as the Legal Analyst. The analyst will be part of the Carter Center EEM to Venezuela.  The analyst will assess the legal framework as well as the legal dynamics in the context of Venezuela’s electoral process. This position will contribute to public and private statements regarding the electoral process to provide an impartial assessment of the elections.

This position is contingent on electoral developments. Deployment to Caracas, Venezuela is expected to be in October-December 2021. Applications will be reviewed on a rolling basis until the position is filled.

Primary responsibilities:

The Legal Analyst will be responsible for engaging with key legal stakeholders to assess Venezuela’s legal framework. S/he will:

  • Become familiar with the Venezuelan legal, regulatory, and constitutional framework. Assess technical procedures and challenges for political parties, movements, and citizens in general as authorities deal with legal challenges and other relevant issues against national legislation, administrative procedures, and international obligations for democratic elections.
  • Act as an advisor on legal issues to the mission, including liaising with the Supreme Justice Tribunal, the National Electoral Council of Venezuela (CNE) and other key government agencies and stakeholders.
  • In close collaboration with the core team and Atlanta staff, contribute to an overall analysis of the legal environment in Venezuela.
  • Prepare a written legal framework assessment, including analysis of legislation related to the conduct of elections and political participation in Venezuela, the constitution, and Venezuela’s international human rights commitments. Document and analyze election complaints and appeals.
  • In coordination with the Mission Director and Atlanta staff, assume the lead role in drafting sections related to legal issues for internal and external reports and statements, including the final report.
  • Meet with representatives of political parties and movements, the judiciary, NGOs and civil society, national observer groups and other key stakeholders, in coordination with members of the EEM, to gather data and information about legal issues. 
  • Prepare briefings and memos as requested on key aspects of election administration regarding legal challenges in the context of the November 2021 regional elections.
  • Assist in drafting Carter Center mission press releases, public statements, and project reports with a lead role in assessing the legal framework and election administration as it relates to electoral violence.

Qualifications:

Ideal candidates will possess some or all the following qualifications:

  • Demonstrated experience on previous election observation missions as a legal analyst, and at least five years in the democracy, governance and/or elections field are required.
  • Law or advanced degree in relevant field is preferred.
  • Excellent knowledge of human rights and democratic election standards and familiarity with the technical procedures required for constituency delimitation, voter registration, candidate registration, and other steps of electoral preparation.
  • Demonstrated ability to provide advice, guidance and analyses regarding election legislation and legal frameworks is required.
  • Candidates with a demonstrated understanding of Venezuelan legal dynamics with emphasis on electoral issues and experience working or living in Venezuela and/or the region will be given highest consideration.
  • Strong experience working on election observation missions, election administration focusing on analysis of electoral violence of various types as well as a strong knowledge of election observation methodologies
  • Demonstrated legal experience and knowledge of election law and international obligations concerning human rights, political and electoral rights, electoral and political violence
  • Excellent organizational, oral, and written communication skills
  • Fluency in Spanish and English, both written and spoken, is required.
  • Leadership skills, cross-cultural understanding, and a background working in sensitive political situations are required.
